2. What is the Belgian Official Gazette?
The Belgian Official Gazette (Belgisch Staatsblad / Moniteur Belge) is the official publication of the Belgian government. Everything that must be legally public — from new laws to company changes — is published here. Think of it as Belgium's "logbook": if it's not in the Gazette, it legally doesn't exist for the outside world.
For entrepreneurs, the Gazette is mainly relevant when incorporating or modifying your company or association. When you set up a BV, change directors or amend your articles, this must be published so that everyone — customers, suppliers, banks, government — can verify who's behind your company and what the rules are.
Why does this exist? Transparency and legal certainty. Through publication, everyone knows who is authorised to represent your company, what its purpose is, and whether it's still active. Without publication, important decisions cannot be enforced against third parties.
What you need to remember as a business leader:
- You don't have to do it yourself — your notary, accountant or social secretariat handles it for you
- It costs a fixed amount per publication (see tariffs below), regardless of the number of pages
- You have 30 days to file a modification after the decision
- As long as something isn't published, it doesn't apply to the outside world — that can cost you money and liability
3. When do tariffs change?
Tariffs are indexed annually on 1 March, based on the consumer price index. This is established by the Royal Decree of 29 April 2019.
The increase was approximately 3.2% between 2024 and 2025, and approximately 2% between 2025 and 2026.
In practice: expect one tariff adjustment per year around 1 March. Not more often or randomly. So if we're late updating this article, you can expect a 3-4% increase. No panic, we've included the sources for you!
4. What must you publish?
Based on the Companies and Associations Code (WVV, articles 2:8 to 2:17), you must publish:
Sounds like a lot? Don't worry. In practice, you don't have to do this yourself. When incorporating, you simply sign at the notary, and the rest (filing, publication, CBE registration) is handled for you by your notary, accountant or social secretariat. You barely notice it.
Not required:
- Partnership (no legal personality) — no publication obligation
- Internal management decisions that do not affect articles or governance
- Day-to-day operational matters
5. How does the procedure work?
There are several ways to file a publication:
Via an intermediary (most common method)
Accountants, enterprise counters (Xerius, Liantis, Acerta) or legal advisors can handle the filing with a power of attorney.
Via the notary (e-Depot)
The notary prepares the deed and files everything electronically via e-Depot. This is mandatory for incorporation of BV and NV (notarial deed required). Publication costs are included in the notary's invoice.
Paper at the registry
You fill in Forms I and II, sign the original in blue ink, and submit at the registry of the enterprise court. Payment via bank transfer to BE48 6792 0055 0227.
e-Registry (www.e-griffie.be)
Online filing with your eID. Currently only available for incorporation of legal entities by private deed (such as VZW). Payment via Visa, Mastercard or Bancontact.
Termijn publicatie: The registry must ensure publication within 10 calendar days of filing.
Termijn neerlegging: You must file a modification within 30 days of the definitive deed or decision.
6. What if you publish late?
The legal deadline for filing is 30 days after the definitive deed. If you publish late or not at all, you risk:
